West Bengal Pollution Control Board

Consent to Establish (NOC) by West Bengal Pollution Control Board
   As per provisions of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 all new intending projects (Developmental & Industrial) required to obtain "Consent to Establish" (popularly termed as NOC) from State Pollution Control Board. Depending upon the pollution and hazard potential of industrial activities, the industries are categorised as Special Red , Ordinary Red , Orange , Green and Exempted. 

There are sitting restrictions for special red, ordinary red and orange category of industries. Prospective entrepreneurs should take into account these restrictions while selecting land for their proposed industries.

For obtaining NOC from the West Bengal Pollution Board, the entrepreneurs are required to apply in prescribed Application Form which can be downloaded from here.

Some of the important information and documents required to be submitted along with the application form are as follows :-
   Information
  • List of raw materials consumed (with quantity) and products (with quantity) per day.
  • Process flow chart and details.
  • Amount of water and different type of fuels per day.
  • Quantity of liquid wastes generated per day and its characteristics.
  • Expected quantity and characteristics of gaseous emissions (fuel burning and process)
  • Expected quantity of solid wastes generated including hazardous solid waste.
  • Proposal for controlling/ treatment of liquid, solid and gaseous emissions.

The application form should accompany a fee depending on the investment size of the project.

 Environmental Clearance from Government of India
Besides obtaining No Objection Certificate from Pollution Control Board, environmental clearance from Ministry of Environment & Forest, Govt. of India is also mandatory for 30 specific categories of project.
If the investment for the following projects is MORE than Rs. 50 Crores.
  1. Nuclear Power and related projects such as Heavy Water Plants, nuclear fuel complex, rare earth's
  2. River Valley projects including hydel power, major irrigation and their combination including flood control
  3. Petroleum Refineries including crude and product pipelines
  4. Chemical Fertilizers (Nitrogenous and Phosphatic other than single superphosphate)
  5. Petrochemical complexes (both olefinic and aromatic) and petro-chemical intermediates such as DMT, Caprolactam, LAB etc. and production of basic plastics such as LDPE, HDPE, PP, PVC
  6. Exploration for oil and gas and their production, transportion and storage
  1. Synthetic Rubber
  2. Hydrocyanic acid and its derivatives,
  3. (a) Primary metallurgical industries (such as production of Iron and Steel, Aluminium, Copper, Zinc, Lead and Ferro Alloys) (b) Electric are furnaces (Mini Steel Plants)
  4. Chlor-alkali industry
  5. Viscose Staple fiber and Filament yarn
  6. Storage batteries integrated with manufacture of oxides of lead and lead antimony alloy
  7. Thermal Power Plants
  8. Highway Projects
  9. Pulp, paper and newsprint
  10. Cement
If the projects are located or proposed to be located in areas OTHER than COASTAL REGULATION ZONE covered by MoEF Notification No. S.O.114(E), Dated 19.0291
  1. Ports, Harbors, Airport (except minor ports and harbors)
  2. All tourism projects between 200m - 500 meters of High Tide Line or at locations with an elevation of more that 100 meters with investment of more than Rs. 5 crores

Irrespective of the project size provided items manufactured is NOT RESERVED for Small Scale Industrial sector

These Categories of projects are also subjected to environmental public hearing. The projects are also required to submit Environmental Impact Assessment (EIA) report and Environmental  Management Proposal (EMP) both to Pollution Control Board and Ministry of Environment & Forest, Govt. of India. For obtaining clearance from Govt. of India for such projects application in prescribed format should accompany following document :-

  • No Objection Certificate for State Pollution Control Board
  • EIA & EMP report
  • Filled in questionnaire (as prescribed by Ministry of Environment & Forest from time to time) for environmental appraisal of the project.

# Siting policy for Special Red category industries : Industries mentioned in the list of Special Red category cannot be permitted in Municipal areas falling under Kolkata Metropolitan Area (KMA). These can however be set up beyond the Municipal areas of KMA with adequate pollution abatement system subject to site clearance by local bodies. However, for the categories of industries in serial number 23, 25, 29, 40 & 46 of the above list, the consideration for siting in KMA will be location specific and will be decided by the Board.

# Siting policy for Orange category industries : Industries mentioned in the list of Orange category can be permitted in all municipal areas other than Kolkata Municipal Corporation (KMC) and Howrah Municipal Corporation (HMC) areas [except added areas of HMC] or within Industrial Estates in case of KMC & HMC area with adequate pollution control measures subject to the condition that the site clearance should be obtained from the Municipal authorities for siting up of new units. However, for the categories of industries in sl. nos. 1, 11, 13, 14, 24, 30 & 32 of the above list, the consideration for siting outside industrial estates in KMC & HMC area will be location specific and will be decided by the Board.
